For an online Shopify store, the key rules include the Consumer Protection Act 68 of 2008 (CPA) and the Electronic Communications and Transactions Act 25 of 2002 (ECTA). The CPA provides important quality/warranty protections, including the six-month implied warranty for qualifying defects, while ECTA provides a seven-day cooling-off right for qualifying electronic transactions.

At ROVA, we want you to be confident when purchasing our 3-in-1 Jump Starter, Tyre Inflator and Emergency Light.

This Returns, Refunds & Warranty Policy applies to purchases made through our website and is intended to explain the circumstances in which products may be returned, repaired, replaced or refunded.

This policy is governed by the laws of the Republic of South Africa, including the Consumer Protection Act 68 of 2008 ("CPA") and, where applicable, the Electronic Communications and Transactions Act 25 of 2002 ("ECTA").

Nothing in this policy is intended to remove, restrict or waive any right that a consumer has under applicable South African law. Where a mandatory legal right applies, that right will prevail over this policy.


1. CHANGE-OF-MIND RETURNS

If you purchase ROVA online and simply change your mind, your rights may depend on the circumstances of the transaction.

Electronic transaction cooling-off period

Where the ECTA applies, a consumer may cancel a qualifying electronic transaction for the supply of goods without giving a reason and without penalty within 7 days after receiving the goods.

The consumer may be responsible for the direct cost of returning the product.

Where payment has already been made, the applicable refund must generally be made within 30 days of cancellation. (SAFLII)

The ECTA cooling-off right is subject to the exclusions contained in the Act.

For example, section 44 does not apply to certain categories of goods and transactions, including goods made to a consumer's specifications, clearly personalised goods, goods that by their nature cannot be returned, and certain other listed transactions. (SAFLII)


2. PRODUCT CONDITION FOR A CHANGE-OF-MIND RETURN

Where a lawful cooling-off or other applicable change-of-mind return applies, please return the ROVA product as soon as reasonably possible and preferably with:

  • The original packaging

  • All accessories

  • Jump-start cables/clamps

  • Inflation hose and fittings

  • Instruction materials

  • Any included components

  • Proof of purchase/order number

The product should not have been unnecessarily damaged, modified or altered.

However, these requirements do not remove or restrict statutory consumer rights that apply to defective, unsafe or non-compliant goods.


3. DEFECTIVE, FAULTY OR UNSAFE PRODUCTS

ROVA products are covered by the statutory protections applicable under South African consumer law.

Under section 55 of the CPA, consumers have rights relating to goods being reasonably suitable for their generally intended purpose, of good quality, in good working order and free of defects, and usable and durable for a reasonable period considering the circumstances. (SAFLII)

Section 56 provides an implied warranty of quality.

Where qualifying goods fail to satisfy the applicable section 55 requirements within six months after delivery, the consumer may return the goods without penalty and at the supplier's risk and expense, and the consumer may direct the applicable remedy of repair, replacement or refund, subject to the CPA. Important

The six-month statutory protection is not a blanket six-month "change of mind" return period.

It applies where the goods fail to satisfy the applicable statutory quality requirements.


4. WHAT MAY NOT QUALIFY AS A PRODUCT DEFECT

A product may not qualify for a defect-related remedy where the problem was caused by circumstances such as:

  • Misuse or abuse of the product

  • Accidental physical damage

  • Dropping or crushing the unit

  • Water or liquid damage where the product is not designed for such exposure

  • Unauthorised opening or repair

  • Unauthorised modification

  • Damage caused by incorrect installation or connection

  • Use contrary to the supplied instructions

  • Use with incompatible equipment or vehicles

  • Using the product outside its stated specifications

  • Damage caused by accessories or equipment not supplied with ROVA

  • Damage occurring after the product was altered by the consumer

The CPA itself recognises circumstances involving goods being altered contrary to instructions or after leaving the control of the relevant supplier in relation to the implied warranty. (Gov.za)

Nothing in this section limits any statutory right where South African law provides otherwise.


5. JUMP-START FUNCTION

ROVA's jump-start function should only be used with vehicles and applications compatible with the product's specifications and instructions.

Customers must carefully follow the supplied instructions when connecting the jump-start cables.

ROVA should not be used:

  • On an incompatible vehicle or electrical system

  • Outside the product's stated specifications

  • With damaged cables or connectors

  • If the equipment appears damaged

  • In a manner contrary to the supplied instructions

  • After unauthorised modification

Customers should verify compatibility before use.

ROVA is an emergency roadside assistance device and does not replace professional automotive diagnosis or repair.


6. TYRE INFLATION FUNCTION

The tyre inflator should be used only for suitable tyres and applications within the product's stated specifications.

Customers should:

  • Check the vehicle manufacturer's recommended tyre pressure

  • Follow the product instructions

  • Check the tyre and valve before inflation

  • Stop using the device if the equipment or tyre appears damaged

ROVA is not a substitute for professional inspection or repair of a structurally damaged, severely punctured or otherwise unsafe tyre.


7. ACCIDENTAL DAMAGE AND NORMAL WEAR

ROVA does not provide a general replacement or refund for damage caused by accidents, misuse, abuse, unauthorised modifications or normal deterioration arising from ordinary use, except where applicable South African law provides otherwise.

Examples include:

  • Scratched or cracked housing caused by impact

  • Broken connectors caused by force

  • Damaged cables caused by improper handling

  • Damage caused by dropping the unit

  • Damage caused by liquid exposure

  • Damage resulting from unauthorised repairs

  • Damage resulting from using the device contrary to its instructions


8. HOW TO REQUEST A RETURN

To request a return, contact us using the contact details published on our website.

Please provide:

1. Full name
2. Order number
3. Date of purchase
4. Date the product was received
5. Reason for the return
6. Description of the problem, where applicable
7. Photographs or video showing the issue, where reasonably requested

We may request reasonable information necessary to assess the nature of the return.

For defective-product claims, we may need to inspect or test the product before determining the appropriate remedy, where permitted by law.


9. RETURN SHIPPING

Change-of-mind / ECTA cooling-off

Where the ECTA cooling-off right applies, the consumer may be responsible for the direct cost of returning the goods. (SAFLII)

Defective or qualifying goods

Where a product qualifies for a statutory remedy under the CPA, the applicable return will be handled in accordance with the consumer's statutory rights, including the applicable rules concerning supplier risk and expense. (Gov.za)

Customers should not send products to an address without first obtaining return instructions from ROVA.


10. REFUNDS

Where a refund is legally required or approved under this policy, the refund will generally be made using the original payment method where reasonably possible.

Refund processing may depend on the payment provider or financial institution.

Where a statutory timeframe applies, ROVA will comply with that timeframe.

For ECTA section 44 cancellations, the Act provides for the applicable refund to be made within 30 days of cancellation. (SAFLII)


11. REPLACEMENTS

Where a qualifying product is defective and replacement is selected or otherwise required under applicable law, ROVA may provide a replacement product subject to availability and the applicable legal requirements.

If the same product is unavailable, the appropriate remedy will be determined in accordance with applicable law.


12. REPAIRS

Where repair is an applicable remedy, ROVA may arrange for the product to be inspected and repaired.

If a product has been repaired and the relevant failure, defect or unsafe feature is not remedied, or another relevant failure/defect/unsafe feature is discovered within the period specified by section 56(3), the CPA provides for further remedies, including replacement or refund. (Gov.za)


13. DAMAGE DURING DELIVERY

If your ROVA product arrives visibly damaged, please contact us as soon as reasonably possible and provide photographs of:

  • The shipping packaging

  • The product

  • The damaged area

  • The shipping label

We may use this information to investigate the delivery issue with the courier.

This procedure does not remove any statutory consumer rights.


14. INCORRECT OR INCOMPLETE ORDERS

If you receive an incorrect product or your order is missing an item, contact us as soon as possible.

Please provide:

  • Order number

  • Photograph of the package

  • Photograph of the product received

  • Description of what is missing or incorrect

We will investigate and, where appropriate, arrange the applicable remedy.


15. UNDELIVERED OR RETURNED PARCELS

If a parcel is returned to ROVA because the customer:

  • Provided an incorrect address;

  • Failed to provide sufficient delivery information;

  • Repeatedly failed to accept delivery; or

  • Failed to collect the parcel where collection was required,

we may contact the customer to arrange further delivery.

Any additional delivery costs will be handled in accordance with the circumstances and applicable law.

Nothing in this section limits a consumer's statutory rights relating to failure to deliver goods or failure to perform the transaction.

ECTA section 46 contains rules concerning agreed delivery periods and certain cancellation/refund rights where an electronic order is not executed as required. (SAFLII)


16. PRODUCT SAFETY

ROVA is designed as a roadside emergency device.

Customers must read and follow the instructions supplied with the product before operating it.

Do not use the product if:

  • It appears damaged;

  • Cables are damaged;

  • Connectors are damaged;

  • The unit shows signs of overheating or other abnormal operation; or

  • You believe continued use could be unsafe.

Stop using the product and seek appropriate professional assistance where necessary.


17. LIMITATION OF THIS POLICY

ROVA does not exclude liability or consumer rights that cannot lawfully be excluded under South African law.

Nothing in this policy is intended to:

  • Waive a consumer's statutory rights;

  • Remove the CPA's implied warranty where applicable;

  • Exclude applicable ECTA rights;

  • Avoid an obligation imposed by law;

  • Prevent a consumer from exercising a legal remedy; or

  • Mislead a consumer regarding their legal rights.

The CPA restricts contractual terms that purport to waive or deprive consumers of CPA rights or avoid supplier obligations. (SAFLII)


18. YOUR STATUTORY RIGHTS

This policy is intended to operate together with, and not instead of, applicable South African consumer legislation.

Depending on the circumstances of a transaction, relevant legislation may include:

  • Consumer Protection Act 68 of 2008

  • Other applicable South African legislation and regulations

ECTA section 43 requires an online supplier to make certain information available on its website, including the supplier's name/legal status, physical address, telephone number, email address, product characteristics, full pricing information, payment methods, applicable terms, delivery period, return/refund policy and applicable consumer rights.
